CarWhoWa Terms of Use
Last updated: 28 October 2026
Welcome to CarWhoWa (also referred to below as “the Service”).
The Service is provided and operated by 勝崨有限公司 (Next Innovation Ltd., referred to below as “the Company”, “we”, or “us”).
These Terms of Use (“these Terms”) govern the rights and obligations between you and the Company when you use the Service website, member accounts, parking QR Codes, move-car notices, paid plans, physical goods, and related services.
When you register as a member, buy goods or services, or use related features, you should follow these Terms in the applicable context. We will provide the Terms and an appropriate confirmation method in the registration or checkout flows where needed.
The Service also has a CarWhoWa Privacy Policy that explains collection, processing, use of personal data, and related rights. Personal-data matters are handled under the Privacy Policy and applicable law.
These Terms are based on the laws of the Republic of China (Taiwan). For users who are legally entitled to mandatory consumer-protection rules of another country or region, these Terms do not exclude the rights those laws grant.
1. Definitions
- Member account: an account created when a user registers or signs in through LINE Login or Google Login.
- Owner member: a member who uses the Service to manage vehicles, contact details, parking QR Codes, and related plans.
- Scanner / contacting person: a person who scans a parking QR Code, opens the contact page, sends a message to the owner, or views contact methods.
- Parking QR Code (move-car code): a QR Code generated by the Service that links to a specific vehicle’s contact page.
- User content: text, move-car messages, support messages, images, attachments, or other materials a user submits through the Service.
- Free plan: a plan offered by the Service that does not require a subscription fee and has specific quotas and feature limits.
- Paid plan: a plan under which a user pays a fee and, for an agreed period or under agreed conditions, receives specified features and quotas.
- Physical goods: QR Code stickers or other tangible goods sold by the Company through the Service.
- Third-party services: external services we integrate for login, notices, payments, cloud computing, email, e-invoices, analytics, or advertising.
2. Eligibility and minors
- The Service is open to users who may register and use it under applicable law.
- Minors who register or use the Service must obtain any consent that applicable law in their place of residence requires from a legal guardian.
- Minors who subscribe to a paid plan or buy physical goods must confirm they have the guardian consent or authorization required by law.
- Users must provide true, accurate information they are entitled to use, and must not impersonate others or misuse another person’s account or vehicle information.
- If we have reasonable grounds to believe an account involves impersonation, lack of required authorization, or other unlawful conduct, we may take appropriate measures under these Terms, without affecting rights users have under law.
- Scanners may use the public parking-contact page without registering, but must still follow the rules that apply to that use.
3. Service content and how to use it
(1) Service content
The Service mainly provides:
- Owner-member registration and account management.
- Management of vehicle data and contact details.
- Generation, management, and disabling of parking QR Codes.
- Move-car contact through a web page.
- Move-car notices through supported messaging platforms.
- Features and quotas under free and paid plans.
- Purchase of QR Code stickers and other physical goods, and related services.
Actual features, plan limits, and goods are those published by the Service at the time and confirmed at the transaction.
(2) Using parking QR Codes
- Owner members may create and manage parking QR Codes through the Service.
- Scanners may scan a QR Code with a phone to open a web page and make contact, without downloading an app or registering.
- Owner members must keep the vehicle and contact details linked to a QR Code accurate and valid.
- Owner members may generate a new QR Code and disable an old one through the Service. Regenerating a QR Code does not itself incur an extra QR Code fee.
- QR Codes should be placed where they do not block the driver’s view and do not violate traffic or vehicle-safety rules.
(3) Phone-number display mechanism
- Owner members may choose, among the options the Service offers, to display a contact number immediately or to receive notices by move-car message first.
- Even if message-first is selected, when either the notice count or the waiting time reaches the system threshold, the contact page will still display the phone number the owner provided.
- That mandatory display is a contact rule of the Service. Owner members cannot turn it off.
- When a plan’s message quota is used up, the Service stops the corresponding push notices, and the scan page displays the owner’s phone number instead.
- Owner members should understand this mechanism before using the Service, and should confirm that the number they provide is suitable for parking contact.
- Once a number is shown to a scanner, we cannot guarantee the other party will not record it. No one may use obtained data for harassment, fraud, or other unlawful purposes.
(4) Nature and limits of the Service
- The Service is a parking-contact and notice aid. It is not emergency rescue, police work, roadside assistance, or traffic enforcement.
- We do not guarantee that a notice will arrive immediately, that the owner will reply, or that the owner can move the vehicle at once.
- Users must not use the Service as a substitute for parking duties, traffic rules, or necessary emergency reporting required by law.
- In cases of personal safety, traffic accidents, or other emergencies, users should contact the appropriate emergency service or authority.
4. Account registration, management, and security
- The Service currently supports LINE Login and Google Login.
- Users must ensure they lawfully hold the login account or have proper authorization to use it.
- Users must take care of third-party login accounts and related verification methods so they are not used without authorization.
- Members must keep plate numbers, contact numbers, and other details accurate, and update them when they change.
- No one may log in to, operate, sell, or transfer another person’s account without authorization.
- If you discover unauthorized use of an account, contact us as soon as possible.
- We may take reasonably necessary account-protection measures, including re-verification, limiting certain actions, or temporarily suspending access.
- Unauthorized use of a user’s account does not automatically relieve us of information-security or other duties we have under law.
5. Payment, subscriptions, invoices, and refunds
(1) Plans and prices
- The Service offers a free plan and different types of paid plans.
- Price, term, vehicle count, message quota, conversation viewing window, and other limits are those disclosed on the purchase page at the time of purchase.
- The Service may offer different billing cycles or purchase methods. Whether a plan auto-renews depends on the plan you choose and the conditions clearly disclosed at checkout.
- Buying a paid plan does not by itself mean we have authorization to charge every later period automatically.
(2) Payment and activation
- Users must complete payment according to the amount, method, and conditions shown at checkout.
- The Service uses third-party payment providers to process transactions.
- Paid digital services activate immediately after successful payment and provide the rights of the purchased plan.
- Users should confirm plan content, fees, term, and renewal conditions before paying.
- If payment cannot be completed because of a failed transaction, a payment dispute, or other necessary reasons, we may delay activating paid features according to the actual situation.
(3) Auto-renewal
- If you choose a plan with auto-renewal, we will clearly disclose the renewal cycle, amount, charging method, and how to cancel before you subscribe.
- Auto-renewal charges follow the billing terms you agreed to and the payment provider’s operating rules.
- You may cancel auto-renewal through the management features the Service provides.
- After cancellation, later periods will not be charged automatically under that subscription authorization. Paid features already paid for remain available until the current term ends.
- Cancelling auto-renewal is not the same as cancelling a completed transaction, and does not by itself create a refund.
- If a charge fails, later access under the plan follows the rules disclosed at purchase and applicable law.
(4) Upgrades and new subscriptions
- Free-plan members may buy a paid plan among the options the Service offers.
- Paid plans currently cannot be downgraded directly or switched to another paid plan within an existing subscription.
- To change paid plans, you must subscribe again through the flow the Service provides.
- When a new subscription takes effect relative to an old one, and how fees and benefits work, are those clearly disclosed at the transaction. These Terms do not assume unused fees are automatically credited.
(5) Plan expiry
- When a paid plan expires and there is no continuing valid subscription, member service automatically adjusts to the free plan.
- The original QR Code may continue to be used; expiry alone does not require generating a new one.
- After expiry, vehicle count, message quota, conversation viewing window, and other features follow free-plan rules.
- If usage under the former paid plan exceeds free-plan limits, available features will be limited by free-plan quotas and system rules.
- Expiry does not mean related data has already been deleted from backend systems. Retention and deletion follow the Privacy Policy.
(6) E-invoices
- We issue e-invoices or other lawful transaction documents according to applicable law and the actual transaction.
- Users must provide correct email, tax ID, mobile barcode carrier, charity donation code, or other necessary details.
- Invoice information may be reviewed through the billing tools the Service provides.
- Correction, voiding, or other handling of issued invoices follows relevant law and e-invoice operating rules.
(7) Refund principles
- Paid plans are generally not refundable at will. In special cases, users may contact support; we will review the actual situation.
- The principle above does not limit rights to cancel, terminate, obtain a refund, or claim damages under Taiwan’s Consumer Protection Act, other applicable law, or the contract.
- Digital services activate immediately after successful payment, but immediate activation itself does not mean you automatically lose any seven-day cooling-off right you have under law.
- If a transaction legally falls under an exception to the distance-selling cooling-off right, we will clearly inform you before the transaction and complete any consent or other procedure the law requires.
- If a refund is required by law, we will handle it according to the law and the transaction.
- Refunds are generally processed through the original payment channel. If law or the actual transaction requires another method, we will use that method.
(8) Physical-goods transactions
- The Service sells QR Code stickers and other physical goods.
- Product name, specifications, price, shipping, delivery method, and expected delivery information are those on the purchase page and in the order confirmation.
- Consumers’ cooling-off rights for distance selling are not automatically excluded merely because the goods are QR Code stickers.
- If goods truly fall under a legal exception such as customized goods, we will clearly disclose the conditions before the transaction.
- Defects, wrong shipments, delivery disputes, and returns/exchanges are handled under applicable law and the actual transaction.
- These Terms do not exclude statutory warranties for defects or other legal rights of consumers.
6. Acceptable use and prohibited conduct
Users must not use the Service to:
- Violate applicable law, court judgments, or lawful orders of competent authorities.
- Impersonate another person or misuse another person’s plate number, member account, or contact details.
- Send threats, insults, harassment, fraud, extortion, or other unlawful content.
- Use move-car contact to stalk, harass, or make other improper contact unrelated to parking.
- Repeatedly scan in bad faith, flood messages, or interfere with the Service through automation.
- Collect, publish, sell, or use another person’s phone number or other personal data without authorization.
- Attempt unauthorized access to systems, accounts, databases, or other technical resources.
- Use programs, scripts, or other means to bypass normal quotas, security measures, or access limits.
- Spread malware, disrupt the Service, or cause improper harm to other users.
- Resell, rent, or sublicense the Service without our authorization.
- Infringe intellectual-property, privacy, reputation, or other lawful rights of the Company or third parties.
We may take reasonable, proportionate measures according to the violation, the risk, and applicable law.
7. User content and license
- Users are responsible for messages, text, images, and other content they submit.
- Users must have the right to provide that content, and the content must not infringe third-party rights.
- Users retain the rights they have in user content under law.
- To provide parking contact, send notices, maintain the system, and handle support and disputes, we may store, process, transmit, and display user content to the extent necessary.
- That use does not transfer copyright or other intellectual-property rights in user content to the Company.
- If content appears unlawful, infringing, or in breach of these Terms, we may limit display, stop transmission, delete it, or take other necessary steps according to the circumstances.
- Retention of related content and processing of personal data follow the Privacy Policy and applicable law.
8. Privacy and personal data
- We collect, process, use, and retain personal data under the CarWhoWa Privacy Policy and applicable law.
- The Service involves processing owner contact numbers, plate numbers, scanner messages, member data, payment information, and related technical logs.
- Owners should understand the mandatory phone-number display mechanism in Section 3.
- Scanners must not use an owner’s contact details obtained through the Service for unlawful or improper purposes unrelated to parking contact.
- Users may exercise personal-data rights under applicable law.
- If these Terms and the Privacy Policy conflict on personal-data matters, the conflict will be resolved under applicable law and in a way that protects the data subject’s lawful rights. Contract wording must not be used to limit statutory rights.
9. Third-party services
- The Service integrates third-party login, notices, payments, e-invoices, cloud computing, analytics, and advertising.
- Third-party services currently used include Cloudflare, AWS, LINE, Telegram, Google, PayUNi, and e-invoice providers.
- Third-party services may have their own terms, privacy policies, and technical limits.
- Outages, interruptions, limits, or policy changes at a third party may affect some features of the Service.
- We will take reasonable maintenance, adjustment, or notice measures according to the actual situation.
- Matters for which a third-party provider is independently responsible are handled under the relevant contracts and law. Using a third party does not relieve us of duties we have under law.
10. Intellectual property and license to use
- Intellectual-property rights in the Service’s website, software, architecture, interface design, trademarks, logos, text, images, and other protected content belong to the Company or the lawful rights holder.
- Users receive only the right to use the Service under these Terms and the relevant plan. Using the Service does not transfer ownership of our systems, trademarks, or other content.
- Users may, within what the Service allows, generate, download, print, and display parking QR Codes they have lawfully obtained, for vehicle contact.
- Without authorization, users may not copy, distribute, sell, or otherwise use protected content beyond ordinary use.
- Except as the law allows or we clearly authorize, users may not crack, circumvent technical protections, or obtain non-public system information without authorization.
- These Terms do not limit fair use, research, or other lawful acts that the law expressly allows.
11. Suspension, limits, and termination
- If a user breaches these Terms, acts unlawfully, infringes third-party rights, or endangers system security, we may take appropriate measures according to the nature and seriousness of the conduct.
- Measures may include warnings, limiting some features, suspending an account, disabling a QR Code, or terminating member service.
- Except where immediate prevention of harm, a serious security risk, unlawful conduct, or other urgent necessity applies, we will give appropriate notice or explanation as the situation allows.
- If service is terminated because of a major breach attributable to the user, under law or a valid contract, fees already paid are generally not refunded.
- The previous sentence does not apply where the law requires a refund, where a clause is legally invalid, where termination is not attributable to the user, or where fees must otherwise be returned by law.
- We may not, merely by our own finding of a breach, exclude a user’s statutory rights to complain, obtain a refund, or claim damages.
- Users who have questions about a suspension or termination may complain through the contact methods in these Terms.
12. Effects of termination and surviving terms
- After a member account ends, related member features and access may stop.
- Adjustment from a paid plan to the free plan because a paid term expired naturally is not automatically treated as termination of the member account.
- Lawful transactions, payments, refunds, damages, and other rights and duties that arose before termination do not automatically disappear because of termination.
- Retention, deletion, and lawful requests regarding user data follow the Privacy Policy and applicable law.
- Intellectual property, legally required liability, dispute handling, and other clauses that by nature should survive continue to apply to the extent necessary.
- Account termination does not relieve us of refund, data-protection, or other duties we must still perform under law.
13. Interruption, change, and discontinuation of the Service
- The Service may be temporarily unavailable because of maintenance, updates, network faults, third-party outages, security incidents, or other factors.
- We will, to the extent reasonably practicable, keep the Service stable and handle known major incidents.
- We may adjust Service content for technical, operational, security, or legal needs, but may not arbitrarily take away important contractual rights a user has already obtained under law.
- If an adjustment involves major features, price, or performance of a purchased plan, we will give necessary notice and handling under applicable law and the transaction terms.
- If we permanently stop all or part of a paid service, we will handle unperformed service obligations and related refunds or other rights according to law.
14. Disclaimers
- The Service provides parking-contact and notice assistance. It does not guarantee that the owner will receive a notice, reply promptly, or move the vehicle.
- We do not guarantee that networks, messaging platforms, and third-party services will be uninterrupted at all times.
- Users remain responsible for complying with traffic and other applicable law.
- Disputes between users arising from parking, moving a vehicle, or other conduct are handled according to the facts and legal liability.
- These Terms do not exclude or limit our liability for intent, negligence, breach of contract, breach of statutory duty, or other liability we have under law.
- Quality, safety, and other duties we have for goods or services under law are not removed by the disclaimers in these Terms.
15. Limitation of liability
- Damages between the Company and users are determined under applicable law, the contract, fault, and actual loss.
- We do not assume liability beyond what the law requires for third-party acts or other events that are entirely not attributable to us.
- If damage is caused jointly by the Company and a user or a third party, each party’s liability is determined under applicable law.
- These Terms do not use the subscription fee a user paid as a blanket cap on all damages liability.
- These Terms do not in advance exclude or limit business-operator liability, liability for intent or gross negligence, or other liability that the law forbids limiting.
- If other applicable law has mandatory rules on limitation of liability, those rules prevail.
16. Indemnity
- If a user, through intent or negligence, violates the law, these Terms, or third-party rights, and causes loss to the Company or others, the user bears corresponding liability under applicable law.
- Whether damages arise, their scope, and their amount are determined by actual loss, causation, fault, and applicable law.
- We may not, merely because a third party makes a claim, require a user to bear all costs unconditionally.
- Allocation of attorneys’ fees, court costs, and other expenses follows applicable law, a valid agreement, or a court judgment.
- These Terms do not affect a user’s right to claim damages or other remedies against the Company under law.
17. Notices
- We may send service notices through site announcements, the member interface, email, LINE, Telegram, or other contact channels you have provided.
- Important notices will use a reasonable method according to the nature of the event, the contact methods available, and applicable law.
- Users should keep member details and notice settings accurate so they can receive necessary messages.
- Whether a notice is legally effective, and when it takes effect, follow applicable law, the nature of the notice, and actual delivery.
- We do not treat mere sending or posting as absolute proof that every legal notice has been validly served.
- Users may send requests, questions, or other notices to the support email in these Terms.
18. Changes to these Terms
- We may revise these Terms because of law, features, technology, or operational needs.
- Revised Terms will be posted on the official website with a last-updated date.
- If a revision involves important rights and duties, we will give necessary notice under applicable law and obtain consent when required.
- Changes generally do not retroactively affect lawful rights already obtained from completed transactions, unless the law provides otherwise or the parties lawfully agree otherwise.
- Continued use of the Service does not, in every case, mean valid consent to every material or adverse contractual change.
- If you do not agree to legally effective new Terms, you may stop using the related Service, and subsequent rights and duties will be handled under applicable law and existing transaction terms.
19. No assignment
- Without our prior consent, users may not sell, assign, or let others use a member account.
- Whether paid plans and related benefits can be transferred follows the rules clearly disclosed at purchase and applicable law.
- These Terms do not limit rights that users may transfer or assert under law.
- If we transfer related contractual rights and duties because of a merger, business transfer, or other lawful reason, we will complete the procedures required by applicable law and the nature of the contract.
20. Severability
- If any part of these Terms is held invalid, unlawful, or unenforceable, that part is handled under applicable law.
- Whether the remaining terms stay in force depends on the purpose of the contract, the relationship among clauses, and applicable law.
- An invalid clause may not, merely because of wording in these Terms, be automatically rewritten into other content that is adverse to the user.
- Ambiguities are handled under applicable law and the principles for interpreting standard-form contracts.
21. Governing law and jurisdiction
- These Terms are in principle governed by the laws of the Republic of China (Taiwan).
- If mandatory consumer-protection laws of another country or region legally apply to a transaction, these Terms do not exclude the rights those laws grant.
- Disputes arising from the Service or these Terms should first be addressed through support or other lawful communication.
- If a lawsuit is necessary, court jurisdiction is determined under applicable law.
- To the extent allowed by law and without violating consumers’ statutory jurisdictional protections, the parties agree that the Taiwan Taichung District Court is the court of first instance.
- The previous clause does not exclude a consumer’s right to sue in another court that has jurisdiction under law.
